What does Royalty-Free mean?

Royalty-Free

A Royalty-Free license provides great flexibility for our buyers to create content with a peace of mind:-

  • with no additional licensing fees required,
  • in unlimited projects forever,
  • across all media worldwide, and
  • safe for commercial use
  • subject to the 4 basic ideas below.

To enjoy all these benefits, your end product has to adhere to a few restrictions. Here we attempt to distill the royalty-free agreement down to a few basic ideas.

4 Basic Ideas

All of the following rules apply to all our stock content, regardless of whether you paid for them or are using our free stock content.

Basic Idea #1

There are 3 main rules to using our royalty-free stock content:

no-tm
You may not use the stock content as a logo, trademark or service mark.

no-porn
You may not use the stock content in any pornographic, illegal purposes or controversial ways.

no-resell
You may not resell or redistribute the stock content.

Basic Idea #2

What does “reselling or redistributing” mean? Here are a few examples.

no-template
You may not use our stock content in screensavers, templates, standalone backgrounds, stock elements, ringtones, etc.

For Photo, Vector and GIF, the physical reproduction limitation is 1,000 units.

no-download
You may not sell or give away our stock content on, for example, your YouTube channel, your website, P2P file sharing services, etc.

For Photo, Vector and GIF, copies of merchandise for sale are not allowed.

If you wish to use the content in products such as templates, electronic greeting cards, screensavers, wallpapers, or any other electronic or printed matter, you have to obtain a prior written consent of MotionElements and/or make payment of additional License Fees.

Basic Idea #3

no-endorse

If a stock content features a model, and you are using the stock content

  • in a manner that suggests the model personally uses or endorses the product or service, or
  • with a subject that would be unflattering, embarrassing or controversial to a reasonable person,

you have to indicate each such use with a statement that indicates that the person is a model and that the content is being used for illustrative purposes only.

Basic Idea #4

You cannot falsely represent or imply that you are the original creator of your end work if a substantial part of its artistic components is from the stock content.

Similarly for stock music, you cannot use them to create derivative work and pass it off as your own, unless they are labeled with “Available For Musical Works”.

You will notice that some of our stock content are labeled with an “Editorial Use Only” label or a “P.R.O.” label. These stock content do also follow the basic Royalty-Free licensing, only that there are certain additional restrictions or fees to their usage.

Advertisements
You want to create an advertisement to show your company as a global company and will like to include videos of skylines around the world.


Websites & Blogs
You want to use a video as a slick background and have duly altered the original video by dropping its frame rate and adding your website’s logo as a watermark.


Events
You want to create an event video. You bought a template to put in videos and photos captured during your event, and customized the template with your event’s name.


Software, Apps & Games
You created a battle game and needed a piece of music for whenever the enemy appears to fight, so you bought a piece of epic music to use.


TV and Films
You have a scene that implies your character has worked through the night, so you bought timelapse footage of night to day.


YouTube
You are creating an edutainment video for your YouTube channel to talk about how blood flows in our body and you bought an animation of red blood cells flowing in blood vessels.

Rest assured the possibilities are not just restricted to these examples, as we all know creativity is limitless.

Can I use your stock content for commercial purposes?

Yes, you can use our stock content for commercial purposes, unless they are marked with Editorial Use Only license.

Editorial Use Only stock content will be clearly marked with a Royalty Free (Editorial Use Only) tag under its licensing specification on the product page.

What does Editorial use only mean?

Editorial use means the primary purpose of using the stock content is to entertain, educate, inform, or comment as in examples below:-

  • Commentary, or opinion in newspaper or magazine articles
  • Blog or website posts (educational and descriptive purposes)
  • Textbooks
  • Documentaries

(Editorial stock content includes celebrities, athletes, famous personalities, brands, designs, trademarked buildings, or large crowds / sports and public events where getting the necessary releases such as model and property releases are almost impossible.)

(Editorial use only stock content cannot be used in a way that promotes, endorses, or advertises a product, brand, or service.)

  • eg. commercials, banner ads, flyers created to promote or endorse any product or service with the intention to raise commercial revenue.)

You are solely responsible for the use of Editorial use only stock content - marked on each product page as shown below:

What is a P.R.O. registered track?

Contributors can register their music tracks with Performing Rights Organizations to protect their copyright and create an additional revenue stream for the usage of the track.

Broadcast & TV Networks normally pay P.R.O.s a fee that is then distributed among its members whose registered tracks are used by the Broadcast & TV Networks.

Rest assured that royalty-free tracks purchased from MotionElements incur no additional cost above the purchase price.

The only difference with P.R.O. registered tracks is that if it is used for TV, film, or used for public performance, buyers should indicate on the cue sheet the P.R.O. details of the music track.

The relevant P.R.O. information fields are as follows:

  1. Title of Track
  2. Composer/Writer
  3. Publisher (if any)
  4. P.R.O. registered to
  5. P.R.O. code (if any)

There are various P.R.O.s in the world, and the amount of information available to be filled in the cue sheet depends on this. Again, this comes at no additional cost to anyone beyond the regular fee that P.R.O.s impose on Broadcast & TV Networks to be in business.

By properly providing the Contributor’s details, not only did you legitimize your use of the track for broadcast and public performance at no additional cost, but also made sure that the Contributor is given a share of the fee given to their P.R.O.s by the Broadcast and TV Networks.

What is YouTube Content ID?

What is YouTube Content ID? Why am i seeing "Matched third party content" on YouTube after I upload my new video?

Don't worry. It's a standard process by YouTube.

When a contributor registers their content with such companies, their content are fingerprinted and saved in the Content ID database. YouTube will run this database across videos that are submitted to them and send a notification if they find a match in their database.

How can I resolve this issue?

If you have purchased the affected piece of content via MotionElements, send:-

Here are the steps to resolve the issue:

Go to "Video Manager" in YouTube

  • Access Video Manager from your YouTube account.
  • Click Matched third party content.

View details of the affected content

You will be brought to the next page where YouTube will show you more details on the affected content.

"File a dispute" with YouTube

Click File a dispute to proceed.

Select your claim

  • Select I have a license or written permission from the proper rights holder to use this material.
  • Click Continue.

Confirm the information

Tick on the check box. Click Continue to proceed.

Enter your claim's explanation

  • Tick the necessary check boxes.
  • Explain briefly that you have purchased the copyright material from MotionElements. Copy and paste your receipt details, share your license certificate and provide a link to our royalty-free end user license agreement.
  • Type in your full name.
  • Click Continue.

The issue should be cleared within the next 1 to 3 working days.

How to download my license certificate

There are 2 ways that you can download your license certificate:

  1. Purchase history tab
  2. Downloads

Download license from Purchase history tab

  1. On the Purchase history tab, find the product that you want to download the license for and click on the license.

If you need to, you can change the licensee to a different name before you download the certificate. You can change the licensee name only once.

Download license from Downloads

  1. At the Downloads box, on the product that you have purchased you can click on the three dots icon and then click “License”

Then you can download your license.

How to change licensee?

(A one-time licensee change is allowed for all pay-per-item purchases.)
The subscription comes with a single-user license (single seat), i.e. no change of licensee is allowed for all stock content downloaded through subscription.

When do you need to change licensee?

All purchases come with a single-seat license that authorizes one user to license and use the content.

  • When you work for a client and buy stock content on behalf of the client who pays for it, you can change the licensee's name to the client to transfer the usage rights over to them.
  • When you made an honest mistake / typo error when filling up your Licensee name!

How to change licensee

On the Purchase history tab, find the product that you want to download the license for and click on the license.

Before you download the license, click “Change”.

On the page that will open, you can change the licensee name. You can change the licensee name only once.
